State v DP, Essex County Superior Court
In State v. DP, Clifford E. Lazzaro, P.C., secured the dismissal of serious charges against a defendant initially facing first-degree robbery, third-degree aggravated assault, and third-degree terroristic threats in Essex County Superior Court. The defendant was arrested in June 2019 and accused of assaulting a woman and stealing money from her purse.
A pretrial detention order was issued on June 7, 2019, and the defendant remained in Essex County Jail. In July 2019, he retained Clifford E. Lazzaro to take over the defense.
Victim’s Sworn Statement Helped Reverse Detention Order
During the case, the alleged victim contacted Lazzaro directly. She expressed that she did not want to proceed with the prosecution, had already informed the Assistant Prosecutor that she would not testify, and wanted the defendant released from custody. She later provided a sworn statement to the defense.
Using this statement, Lazzaro successfully reopened the detention hearing. On August 2, 2019, Judge Nancy Sivilli released the defendant.
Charges Downgraded, Then Dismissed for Lack of Prosecution
On August 19, 2019, the case was downgraded from Superior Court and remanded to municipal court. The State, now without a cooperating witness and lacking sufficient evidence, moved to dismiss the charges. Judge Anthony J. Frasca granted the motion, and the case was officially dismissed in October 2019.
