State v DW, Essex County Superior Court, July 2024
In July 2024, the case of State v. DW was heard in the Essex County Superior Court. DW was charged with murder, attempted murder, conspiracy to commit murder, and multiple weapons offenses. The charges stemmed from a fatal shooting that occurred outside the City Lounge in Newark, New Jersey.
Prosecutors alleged that DW drove from Jersey City to the nightclub with two passengers in his vehicle. Surveillance footage showed all three men entering the club together and later exiting. After DW used his key fob to unlock his car, the two passengers committed the shooting just moments later.
Surveillance and Video Evidence
DW’s presence at the scene was confirmed through multiple surveillance videos and still images. Law enforcement also tracked his vehicle’s movements to and from Jersey City, confirming travel before and after the shooting. Although DW was identified, the two shooters were never positively identified by law enforcement.
One of the passengers allegedly attempted to fire his weapon, but it jammed. The second gunman fired shots that struck two victims. One bullet traveled through a neck and into another victim’s head, resulting in a fatality.
Negotiated Plea Agreement
DW faced a possible sentence of 30 years to life in New Jersey State Prison for the murder charge and 10 to 20 years for attempted murder. Under the No Early Release Act (NERA), he would be subject to 85% parole ineligibility.
However, through a negotiated plea, DW pleaded guilty to conspiracy to commit aggravated manslaughter, with other charges dropped. He was sentenced to 10 years in NJSP with 85% parole ineligibility under NERA. Judge Patrick Arre heard the case.
