State v JE, Mercer County Superior Court, January 2024
In January 2024, the Law Offices of Lazzaro Law resolved a serious drug case in Mercer County Superior Court. Our client, J.E., was initially charged in 2021 with first-degree possession with intent to distribute cocaine. It’s a charge that carries a mandatory New Jersey State prison term of 10 to 20 years.
Strategic Legal Approach
Facing these severe drug distribution charges, our legal strategy focused on limiting exposure to long-term incarceration. We negotiated with the Mercer County Prosecutor’s Office to amend the charge from a first-degree offense to a second-degree possession with intent to distribute. This was a key turning point in the case and opened the door for alternative sentencing options.
Drug Court Admission and Sentencing Outcome
Once the charges were downgraded, we advised J.E. to apply for Drug Court, a rehabilitative program in New Jersey designed for non-violent drug offenders. Our team prepared the application and helped J.E. meet the eligibility requirements. In early 2024, he was accepted into the program.
Instead of serving a decade or more in a New Jersey State prison, J.E. was sentenced to Drug Court’s special probation. This outcome allows him to focus on rehabilitation while avoiding incarceration. The case highlights how skilled negotiation and a strong understanding of alternative sentencing options can drastically change a client’s future.
