State v NG, Middlesex County Superior Court
In 2013, Lazzaro Law represented an 18-year-old client in Middlesex County Superior Court charged with aggravated sexual assault involving a 10-year-old child. The allegations included extreme claims of torture, anal intercourse, and oral sex. The child was the younger brother of the defendant’s best friend, making the case both legally and emotionally complex.
The State recovered DNA evidence from the scene that contained a mixture matching both the alleged victim and the defendant. The defendant also submitted to a polygraph examination during the investigation. Due to the nature and severity of the charges, the defendant faced a maximum prison sentence of 75 years under New Jersey law.
Legal Strategy: Damage Control Through Negotiation
Given the weight of the physical evidence and the seriousness of the allegations, this case required a damage control strategy. Attorney Clifford E. Lazzaro focused on minimizing long-term sentencing exposure and avoiding a de facto life sentence.
The defense secured a plea agreement after negotiations with the Middlesex County Prosecutor’s Office. The original charge of aggravated sexual assault was resolved with an eight-year sentence in New Jersey State Prison, subject to the No Early Release Act (NERA), which requires serving 85% of the sentence. The defendant was also subject to Megan’s Law registration.
Outcome: Sentence Significantly Reduced
This outcome prevented the client from facing decades behind bars and allowed for a return to society at a much younger age. While the charges were severe, strategic negotiation helped limit the impact of what could have otherwise been a lifetime sentence.
