State v PW, Union County Superior Court, May 2022
In May 2022, Lazzaro Law secured a complete dismissal of multiple felony indictments in a high-profile Union County case. Our client, P.W., had been facing two counts of first-degree attempted murder, first-degree unlawful possession of a weapon, and second-degree possession of a firearm by a convicted felon. These charges stemmed from an August 2020 drive-by shooting where two individuals were each shot three times at close range.
Identification Issues and Legal Defense Strategy
The arrest of our client was based entirely on one witness’s identification. The second victim could not identify the shooter. Our review showed that the identification resulted from improper procedures by the Plainfield Police Department. They suggested to the victim that P.W. was the shooter, a clear violation of proper protocols.
Attorney Clifford E. Lazzaro filed a 74-page legal brief challenging the reliability of this out-of-court identification. The motion argued that the identification failed under Henderson factors, which courts in New Jersey use to evaluate the risk of misidentification.
Outcome: All Charges Dropped Before Trial
In August 2021, the Grand Jury returned three separate indictments against our client. We had built a strong defense by May 2022, exposing flaws in the police work and the prosecution’s case. Before the Criminal Presiding Judge, Regina Caulfield, the State dismissed all three indictments, including the attempted murder charges and multiple weapons offenses.
