State v SR, Union County Superior Court
In Union County Superior Court, Lazzaro Law defended a client charged with four serious offenses involving allegations of sexual misconduct with a minor. The State charged the defendant, S.R., with second-degree sexual assault of a minor, second-degree attempted sexual assault, third-degree endangering the welfare of a child, and third-degree attempted endangering the welfare of a child.
If convicted, the defendant faced 5 to 10 years in New Jersey State prison for each second-degree charge under the No Early Release Act (NERA). Conviction would also require lifetime Megan’s Law registration and parole supervision for life.
Trial Strategy and Defense
Attorney Clifford E. Lazzaro personally handled the trial, which took place over two weeks in early August 2010. The defense challenged inconsistencies in the accuser’s statements and highlighted the lack of supporting physical or corroborative evidence. Jury selection, cross-examinations, and expert handling of witness testimony were key in raising doubts about the prosecution’s case.
We focused on creating a clear and direct narrative for the jury, presenting the facts without distraction and keeping the burden of proof squarely on the State.
Outcome: Full Acquittal on All Charges
After just 3 hours and 20 minutes of deliberation, the jury returned a verdict of not guilty on all four counts. The client avoided years of imprisonment, Megan’s Law registration, and the lifelong stigma associated with sex offense convictions.
