SV vs RS, Passaic County Superior Court, 2024
In 2024, Lazzaro Law represented a client in a contentious domestic violence case in the Passaic County Superior Court. The case began when the client’s wife filed for a Temporary Restraining Order (TRO), alleging abuse. A TRO is often granted quickly in New Jersey based on initial claims. It can carry serious legal and personal consequences if it becomes permanent through a Final Restraining Order (FRO).
Final Restraining Order Hearing: April 2024
Our client, S.V., faced the risk of having an FRO issued against him, which would have imposed long-term restrictions on his freedom and damaged his reputation. In preparation for the hearing, we closely reviewed the details of the complaint, examined inconsistencies, and gathered evidence that contradicted the allegations.
At the FRO hearing in April 2024, we effectively challenged the credibility of the alleged victim. The testimony the client’s wife gave lacked consistency and showed signs of fabrication. We demonstrated that the domestic violence claims were unsubstantiated and appeared to be strategically motivated.
Result: Restraining Order Dismissed
The Passaic County Superior Court dismissed the restraining order thanks to our aggressive and focused defense. Our client avoided the burdens of a final restraining order, including a permanent entry into a statewide domestic violence database, loss of firearm rights, and restrictions on contact or visitation.
