United States v TF, United States District Court (NJ/ Trenton)
In 2014, TF appeared in the United States District Court in Trenton, New Jersey. He was charged with violating the terms of his federal supervised release following a prior federal drug conviction. While under supervision, TF was accused of committing new offenses. These charges were also being prosecuted separately in Monmouth County Superior Court under a 22-count state accusation.
TF faced a recommended sentence of 24 to 30 months in federal prison due to the serious nature of the new offenses and the violation of federal release terms. This sentence was set to run consecutively to any state sentence from the Monmouth County case.
Guilty Plea Entered for New Offenses Committed on Federal Supervision
TF admitted to committing new criminal conduct while on supervised release, which directly violated the federal conditions previously imposed. Under federal sentencing guidelines, this violation typically results in a lengthy consecutive prison term.
However, Clifford E. Lazzaro, Esq., representing TF, mounted a strategic and persuasive argument during the federal sentencing hearing. His legal advocacy focused on mitigating factors and the importance of a proportionate response from the court, considering the defendant’s full legal context.
Reduced Sentence Achieved Through Effective Advocacy
As a result of the defense’s efforts, the Court imposed a sentence of 12 months, significantly lower than the 24–30 month federal guideline range. This reduced sentence was a major outcome, especially considering the risk of additional consecutive time stemming from the state charges.
Federal Criminal Defense for Supervised Release Violations
This case highlights the impact of experienced federal criminal defense representation in matters involving supervised release violations, especially when new state-level charges are pending. Lazzaro Law helped secure a favorable result that minimized the client’s federal prison exposure.
